Are mud flaps of the Australian design of the Hummer h3 removable?

I'm asking because I'm planning to fit 37 x 13.5 inch Mickey Thompson MT Z tyres on the H3 with a 4 inch lift kit and mud flaps are not in the grove for me!!|||If the mudflaps were standard factory fitted i've heard you can not legally remove them. Possible modifications to existing mud flaps but you would have to check the ADR's. I wanted to do the same thing(remove them) on my 4x4 but my mechanic said it was a no no.
